While the Sewell’s Landing project in Horse-shoe Bay is greater in scale and is being constructed by developers who have previously erected buildings, it shares at least one common element with the current Gospel Rock proposal in Gibsons: in each case the municipal council required a development agreement, executed as a covenant under section 219 of the Land Title Act.

The amenities on offer were different – mostly money for Sewell’s Landing, mostly park and greenspace for Gospel Rock – but what’s catching my eye as the property-flipping weather arrives is that the District of West Vancouver made sure its agreement included an immediate no-build covenant which would be in force until the amenities cheque cleared.

The Town of Gibsons could have required similar provisions for Block 7, to remain in force until whenever the owning corporation of the moment gets around to making a park dedication and an environmental covenant/stewardship agreement. But I suppose that would have made the next listing agent’s job tougher.
