Gibsons files brief response to Eagleview Heights challenge

Lawyers for the Town of Gibsons have filed a very brief response to a court petition calling for zoning bylaws for a development on Eaglecrest Drive to be quashed.

The Eagleview Heights project will include a mix of 87 townhouse and apartment units, but the O’Shea-Oceanmount Community Association (OOCA) has spoken against its approval, and filed a petition in BC Supreme Court on July 18.

The Town’s response, filed with BC Supreme Court in Vancouver on Aug. 24, says the Town opposes granting any of the orders the community association is requesting and that the Town denies the claims made by the association and “puts the petitioner to strict proof thereof.” It does not lay out any counter arguments.

Chief administrative officer Emanuel Machado told Coast Reporter this week that the Town did not file a detailed response because the community association did not name the developer in its original petition, as required.

“Legal counsels are working on getting that corrected, before we can proceed,” Machado said via email.
