Trucking company sues estate of man who died in Highway 5 crash

A Saskatchewan trucking company is suing the estate of a Kamloops-area man who died nearly two years ago when his vehicle collided with a transport truck on Highway 5 near Little Fort.

Q Line Trucking Ltd. has filed a notice of civil claim in BC Supreme Court against the estate of Joey Ressler, seeking more than $33,000 in towing and repair costs incurred as a result of the crash.

According to the claim, Ressler was driving a 2007 Chevrolet Cobalt on Highway 5 on Feb. 5, 2020, when he lost control. The vehicle struck another truck, then collided with the Q Line semi, the claim states.

Ressler, a 39-year-old man from Clearwater, died in the crash.

“Ressler owed a duty to Q Line to operate the Cobalt to the standard of a reasonably competent driver,” the document alleges.

“Ressler failed to meet that standard by driving too fast for the conditions, not paying attention and/or failing to properly maintain the Cobalt or to ensure it was roadworthy.”

The company is seeking compensation for towing costs and repair costs — $33,917.26 in all.

The North Thompson was pummelled by an intense snow storm in early February of 2020. The weather is believed to have contributed to a number of serious collisions in the area on Feb. 5, 2020, and Feb. 6, 2020.

None of the allegations in the document have been proven in court.
