We are saddened and dismayed by the situation in which we find our council involved.
On a number of occasions, Coun. Alice Lutes breached the confidentiality requirements of the Community Charter by communicating with a person who was being considered for termination about extremely sensitive confidential information. And then she tried to cover this up by deleting emails.
Further, and contrary to what was reported in the media last week, Coun. Lutes has not apologized to council or to the citizens of Sechelt.
Our decision to proceed with this matter was taken based on the best professional advice available and with a focus on ensuring procedural fairness for Coun. Lutes. The investigation into her activities was carried out independently by a law firm. Council then obtained a second legal opinion before proceeding.
Council’s decision to censure her and remove her from her appointments for now, rather than referring this matter to the RCMP or pursuing other action, was taken after careful consideration of the legal duties of council based on all the facts and legal advice, and reflects what is best for the citizens of Sechelt.
